TO AVOID ABANDONMENT OF APPLICANT’S TRADEMARK APPLICATION, THE USPTO MUST RECEIVE APPLICANT’S COMPLETE RESPONSE TO THIS LETTER WITHIN 6 MONTHS OF THE ISSUE/MAILING DATE BELOW.

This Office action is in response to applicant’s communication filed on June 5, 2014.
In a previous Office action(s) dated December 16, 2013, the applicant was required to satisfy the following requirement(s): amend the identification of goods, disclaim descriptive wording in the mark, clarify the mark description and color claim and claim ownership of prior registrations.
Based on applicant’s response, the trademark examining attorney withdraws the following: (1) identification of goods requirement; and (2) disclaimer requirement. See TMEP §§713.02, 714.04.
Further, the trademark examining attorney maintains and now makes FINAL the refusal(s) and/or requirement(s) in the summary of issues below. See 37 C.F.R. §2.64(a); TMEP §714.04.
SUMMARY OF ISSUES MADE FINAL that applicant must address:
Color Claim/Color Description Of Mark
A complete color claim must reference all the colors appearing in the drawing of the mark. See 37 C.F.R. §2.52(b)(1); TMEP §§807.07(a) et seq. Similarly, a complete mark description for a mark depicted in color must identify all the literal and design elements in the mark and specify where the colors appear in those elements. See 37 C.F.R. §§2.37, 2.52(b)(1); TMEP §§807.07(a) et seq. However, if black, white, and/or gray are not being claimed as a color feature of the mark, applicant must exclude them from the color claim and include in the mark description a statement that the colors black, white, and/or gray represent background, outlining, shading, and/or transparent areas and are not part of the mark. See TMEP §807.07(d).
The following amended color claim and mark description are suggested, if accurate:
Color claim: “The colors black, gold and dark gold are claimed as a feature of the mark.”
Mark description: “The mark consists of a dark gold square border with rounded corners containing the letters “IMDb” in black, and two conical gold shapes resembling searchlights emanating from the bottom of the square to the upper corners.”
Claim Of Ownership Of Prior Registration
Applicant may use the following format to claim ownership of the registration:
Applicant is the owner of U.S. Registration No. 3936436.
CONCLUSION
Applicant must respond within six months of the date of issuance of this final Office action or the application will be abandoned. 15 U.S.C. §1062(b); 37 C.F.R. §2.65(a). Applicant may respond by providing one or both of the following:
(1) A response that fully satisfies all outstanding requirements and/or resolves all outstanding refusals.
(2) An appeal to the Trademark Trial and Appeal Board, with the appeal fee of $100 per class.
