Robert Lyons, the owner of Sunleaf Nursery. There is no indication from the Sunleaf Nursery website that the mark MAJESTIC is still being used in connection with honey locust trees or for any other
plant. In addition, the '844 registration is due for renewal on or before August 19, 2014. As of today, when we checked the electronic records of the U.S. Patent and Trademark Office, no application
to renew the registration had been submitted to the U.S. Patent and Trademark Office. As the deadline to place Application Serial No. 86/022,816 in condition for allowance is July 7, 2014, a little
more than a month before the deadline to renew the '844 registration, we would appreciate the Examiner suspending the subject application and withdrawing the final rejection until such time as a
determination is made whether the '844 registration has been renewed. The Examiner is invited to contact the attorney of record to discuss this further if any questions should arise. |
