No Conflicting Marks

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

Indefinite Identification of Goods

The word “system” in the identification of goods in Class 10 is indefinite and must be amended to list the major parts or components of the system, as well as describe the nature, purpose and use of the system.  Applicant should use common generic terms when specifying the parts or components of the system.  See TMEP §§1401.02(a), 1402.01.

 

Applicant may adopt the following identification, if accurate: 

 

Class 10

pharmaceutical and medical waste container systems comprised of [specify components].

 

An applicant may amend an identification of goods only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07 et seq. 

 

If applicant does not respond to this Office action within the six-month period for response, then International Class(es) 10 will be deleted from the application and the application will proceed forward for International Class(es) 37 and 40 only.  37 C.F.R. §2.65(a).
