Response to Office Action

To the Commissioner for Trademarks:

Application serial no. 85958386 ROWENTA (Stylized and/or with Design, see http://uspto.report/TM/85958386/mark.png) has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

The examining attorney has issued an office action stating that the home country registration expired on February 26, 2014.  The examining attorney has apparently assumed incorrectly that the renewal deadline runs from the registration date rather than the application date and, based upon that false assumption, further assumed that the registration has expired.

The copy the registration certification previously submitted by applicant shows on its face that the registration was renewed, has not expired, and that the next renewal deadline is not until July 29, 2022.  The copy submitted in field 186 shows the next renewal deadline of 29/07/2022 (July 29, 2022). 

For the convenience of the examining attorney, applicant is also submitting a print-out from the OHIM website showing the "Expiry date" as 29/07/2022 and showing that a renewal application was filed on August 8, 2012.

Accordingly, applicant respectfully requests that examining attorney withdraw the objection.
