FORM INFORMATION

As permitted by TMEP 806.03(j)(iii), Applicant seeks to amend the basis of this Application to Section 44(e) and elects to not perfect the previously-filed statement of use.

Notice of Allowance issued on October 1, 2013.  Applicant filed a timely statement of use on December 21, 2013, but the specimen sample was rejected in an office action dated March 12, 2014.  This petition is filed in response to that Office Action.

In support of this petition, Applicant submits Singapore Registration No. T1306683B which issued on April 26, 2013 and will remain valid until the next renewal date of April 26, 2023.  Applicant, a Japanese corporation, has offices and employees in Singapore, thus Singapore is a country of origin of Applicant.  The drawing used to illustrate the motion mark in Singapore consists of 10 frames, rather than the five frames used in the U.S. application.  However, each of the five frames used in the U.S. application are included in th Singapore registration (they are Frames 1, 5, 8, 9 and 10), thus the Signapore registration is for the same mark as the U.S. application and meets the requirements of Section 44(e).
