This Office Action is in response to applicant’s Response filed on August 2, 2013, Voluntary Amendment filed on August 10, 2013, and Request to Divide filed on August 15, 2013.

 

 

Requirement for Definite Identification of Goods/Services - Maintained and Made FINAL

 

The examining attorney required that applicant reclassify some of the services in International Class 45.  The applicant amended the identification of goods/services.  However, the identification of goods/services as amended is still indefinite.  Therefore, the requirement for a definite identification of goods/services is maintained and made FINAL. 

 

The identification of goods/services is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the goods/services.  If there is no common commercial or generic name, applicant must describe the products/services and intended consumer(s) as well as its main purpose(s) and intended use(s). 

 

The Office requires a degree of particularity necessary to identify clearly goods and/or services covered by a mark.  See In re Omega SA, 494 F.3d 1362, 1365, 83 USPQ2d 1541, 1543-44 (Fed. Cir. 2007).  Descriptions of goods and services in applications must be specific, explicit, clear and concise.  TMEP §1402.01; see In re Cardinal Labs., Inc., 149 USPQ 709, 711 (TTAB 1966); Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954).

 

In this case, the applicant reclassified all of the services in International Class 45 to International Class 37.  Only some of the services in International Class 45 belong in International Class 37.  The rest belong in International Class 45.

 

Therefore, for the present identification of services to remain in the application, both International Classes 37 and 45 must also remain in the application.

 

Applicant may adopt the following identification of goods/services, if accurate.  See TMEP §1402.01.  The suggested revisions are highlighted or in capital letters. 

 

 

“Installation, maintenance and repair of home and business security and environmental remote monitoring, detection, notification and control equipment, computer hardware, audio-video systems and components thereof,” in International Class 37.

 

"MONITORING OF HOME AND BUSINESS SECURITY SYSTEMS, NAMELY SAFETY SYSTEMS THAT PROVIDE DETECTION, MONITORING AND ALERTS REGARDING INTRUSIONS, FIRE, FLOODING, HAZARDOUS GASES AND TEMPERATURE LEVELS; INTERNET-BASED SOCIAL NETWORKING SERVICES," in International Class 45.

 

 

Identifications of goods and/or services can be amended only to clarify or limit the goods and/or services; adding to or broadening the scope of the goods and/or services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the goods and/or services set forth in the present identification.

 

Periodically the USPTO revises the U.S. Acceptable Identification of Goods and Services Manual (ID Manual) based on changes to the international classification system and the USPTO’s policies regarding acceptable identifications of goods and services.  See TMEP §1402.14.  Identifications are examined in accordance with the Trademark Rules of Practice and the USPTO’s policies and procedures in effect on the date an application is filed.  See 37 C.F.R. §2.85(e)(1); TMEP §1402.14.  However, an applicant may voluntarily choose to follow policies and procedures adopted after the application was filed.  See 37 C.F.R. §2.85(e)(2); TMEP §1401.12.

 

Thus, descriptions of goods and/or services found in earlier-filed applications and registrations are not necessarily considered acceptable identifications when a later-filed application is examined.  See TMEP §§702.03(a)(iv), 1402.14.

Requirements for Multi-Class Applications

 

For an application with more than one international class, called a “multiple-class application,” an applicant must meet all the requirements below for those international classes based on an intent to use the mark in commerce under Trademark Act Section 1(b):

 

(1)       LIST GOODS AND/OR SERVICES BY INTERNATIONAL CLASS:  Applicant must list the goods and/or services by international class.

 

(2)       PROVIDE FEES FOR ALL INTERNATIONAL CLASSES:  Applicant must submit an application filing fee for each international class of goods and/or services not covered by the fee(s) already paid (confirm current fee information at http://www.gov.uspto.report/trademarks/tm_fee_info.jsp).

Only If Applicable - Examiner’s Amendment Recommended

 

Examiner’s Amendments cannot be issued for partial amendments.  However, if all of the  outstanding issues can be resolved through an Examiner’s Amendment, the applicant is encouraged to respond to this Office Action by amending the application in a telephone call with the examining attorney to expedite the processing of the application.  Generally, only the submission of arguments to overcome a substantive refusal or an informal requirement, a requirement for the submission of specimens, a particular document or declaration, or the payment of a fee cannot be handled over the telephone.
