TEAS PLUS APPLICANTS MUST SUBMIT DOCUMENTS ELECTRONICALLY OR SUBMIT FEE: Applicants who filed their application online using the reduced-fee TEAS Plus application must continue to submit certain documents online using TEAS, including responses to Office actions. See 37 C.F.R. §2.23(a)(1). For a complete list of these documents, see TMEP §819.02(b). In addition, such applicants must accept correspondence from the Office via e-mail throughout the examination process and must maintain a valid e-mail address. 37 C.F.R. §2.23(a)(2); TMEP §§819, 819.02(a). TEAS Plus applicants who do not meet these requirements must submit an additional fee of $50 per international class of goods and/or services. 37 C.F.R. §2.6(a)(1)(iv); TMEP §819.04. In appropriate situations and where all issues can be resolved by amendment, responding by telephone to authorize an examiner’s amendment will not incur this additional fee.
The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.
SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION
In this case, the following factors are the most relevant: similarity of the marks, similarity of the goods and/or services, and similarity of trade channels of the goods and/or services. See In re Opus One, Inc., 60 USPQ2d 1812 (TTAB 2001); In re Dakin’s Miniatures Inc., 59 USPQ2d 1593 (TTAB 1999); In re Azteca Rest. Enters., Inc., 50 USPQ2d 1209 (TTAB 1999); TMEP §§1207.01 et seq.
1. Reg. No. 1348547 for ACCESS and design covering “Building Construction Services-Namely, Constructing Buildings and Barrier-Free Facilities for the Physically Disabled.”
2. Reg. No. 4184313 for ACCESS BUSINESS CENTERS covering “Real estate services, namely, rental, brokerage, leasing and management of commercial property, offices and office space.”
3. Reg. No. 2597533 for ACCESS OAKLAND and design covering “Financial valuation of real estate.”
4. Reg. No. 3466893 for ACCESS UPTOWN covering “Assessment and management of real estate; Providing real estate listings and real estate information via the Internet; Real estate agencies; Real estate brokerage; Real estate consultation; Real estate management; Real estate management consultation; Real estate procurement for others; Leasing of real estate; Leasing of real property.”
5. Reg. No. 3346511 for ACCESS CONSTRUCTION covering “Custom construction and building renovation.”
6. Reg. No. 3443282 for DIRECT ACCESS covering “real estate brokerage”.
The applicant's mark ACCESS and design is similar to the cited mark visually and phonetically, differing only by the absence of the wording or design elements appearing in the cited marks. The mere deletion of wording from a registered mark may not be sufficient to overcome a likelihood of confusion. See In re Mighty Leaf Tea, 601 F.3d 1342, 94 USPQ2d 1257 (Fed. Cir. 2010); In re Optica Int’l, 196 USPQ 775, 778 (TTAB 1977); TMEP §1207.01(b)(ii)-(iii). Applicant’s mark does not create a distinct commercial impression because it contains the same common wording as registrant’s mark, and there is no other wording to distinguish it from registrant’s mark. Put another way, the proposed mark is more similar to each of the cited marks than they are to each other.
The presence of design elements in the proposed mark and two of the cited marks also is insufficient to preclude a likelihood of consumer confusion. Although marks must be compared in their entireties, the word portion generally may be the dominant and most significant feature of a mark because consumers will request the goods and/or services using the wording. See In re Viterra Inc., 671 F.3d 1358, 1362, 101 USPQ2d 1905, 1908 (Fed. Cir. 2012); In re Max Capital Grp. Ltd., 93 USPQ2d 1243, 1247 (TTAB 2010). For this reason, greater weight is often given to the word portion of marks when determining whether marks are confusingly similar. In re Dakin’s Miniatures, Inc., 59 USPQ2d 1593, 1596 (TTAB 1999); TMEP §1207.01(c)(ii).
In addition, if the goods and/or services of the respective parties are "similar in kind and/or closely related," the degree of similarity between the marks required to support a finding of likelihood of confusion is not as great as would be required with diverse goods and/or services. In re J.M. Originals Inc., 6 USPQ2d 1393, 1394 (TTAB 1987); see Shen Mfg. Co. v. Ritz Hotel Ltd., 393 F.3d 1238, 1242, 73 USPQ2d 1350, 1354 (Fed. Cir. 2004); TMEP §1207.01(b).
Here, the applicant's identification of "Real estate acquisition services; Real estate brokerage; Real estate consultation; Real estate listing; Real estate management consultation; Real estate management services" encompasses services which are identical or highly related to the real estate brokerage and consulting services identified in Reg. Nos. 4184313, 2597533, 3466893 and 3443282. Similarly, applicant’s real estate development services overlap the construction services encompassed by Reg. Nos. 1348547 and 3346511.
As a result, the services of the parties are likely to move in the same channels of trade to the same classes of purchasers. For example, both the applicant's and registrant’s services would likely be marketed to those wishing to buy, sell, lease or improve real estate and could be used in conjunction with other similar services. Given the similarities of the marks and the services, consumers are likely to conclude that the services are somehow related or emanate from the same source. Accordingly, because confusion is likely, registration is refused under Trademark Act Section 2(d) based on a likelihood of confusion.
Although applicant’s mark has been refused registration, applicant may respond to the refusal(s) by submitting evidence and arguments in support of registration. If the applicant chooses to respond to the refusal to register, the applicant must also respond to the following informality.
The specimen consists of a real estate listing for a commercial properly lease and is not acceptable as evidence of actual service mark use because the listing makes no reference to any of the services applicant has identified in Class 37. Thus, it fails to show proper use of the applied-for mark in the sale or advertising of the services.
Therefore, applicant must submit the following:
(1) A substitute specimen showing the mark in use in commerce for each class of services specified in the application; and
(2) The following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: “The substitute specimen was in use in commerce at least as early as the filing date of the application.” 37 C.F.R. §2.59(a); TMEP §904.05; see 37 C.F.R. §2.193(e)(1). If submitting a substitute specimen requires an amendment to the dates of use, applicant must also verify the amended dates. 37 C.F.R. §2.71(c); TMEP §904.05.
Examples of specimens for services are signs, photographs, brochures, website printouts or advertisements that show the mark used in the actual sale or advertising of the services. See TMEP §§1301.04 et seq.
If applicant cannot satisfy the above requirements, applicant may amend the application from a use in commerce basis under Section 1(a) to an intent to use basis under Section 1(b), for which no specimen is required. See TMEP §806.03(c). However, if applicant amends the basis to Section 1(b), registration will not be granted until applicant later amends the application back to use in commerce by filing an acceptable allegation of use with a proper specimen. See 15 U.S.C. §1051(c), (d); 37 C.F.R. §§2.76, 2.88; TMEP §1103.
To amend to Section 1(b), applicant must submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20: “Applicant has had a bona fide intention to use the mark in commerce on or in connection with the services listed in the application as of the filing date of the application.” 37 C.F.R. §2.34(a)(2); TMEP §806.01(b); see 15 U.S.C. §1051(b); 37 C.F.R. §§2.35(b)(1), 2.193(e)(1).
Pending receipt of a proper response, registration is refused because the specimen does not show the applied-for mark in use in commerce as a service mark. Trademark Act Sections 1 and 45, 15 U.S.C. §§1051, 1127; 37 C.F.R. §§2.34(a)(1)(iv), 2.56(a); TMEP §§904, 904.07(a).
Specimen/Basis Response Options
(1) Submit a verified substitute specimen as follows: (a) answer “yes” to the TEAS response form wizard question to “submit a new or substitute specimen;” (b) on the next page, attach a jpg or pdf file of the substitute specimen; (c) check the box next to the statement “The substitute (or new, if appropriate) specimen(s) was/were in use in commerce at least as early as the filing date of the application”; and (d) on the next page, applicant must personally sign or personally enter his/her electronic signature and date after the declaration at the end of the TEAS response form, and print or type the name of the signatory immediately below or adjacent to his/her signature or identify it elsewhere in the filing.; or
(2) Amend the application to an intent to use filing basis under Trademark Act Section 1(b) as follows: (a) answer “yes” to the TEAS response form wizard questions to “change filing basis” and for a “signed declaration,” respectively; (b) on the next page, uncheck the box for “Filing Basis Section 1(a);” (c) check the box for “Filing Basis Section 1(b);” and (d) on the next page, applicant must personally sign or personally enter his/her electronic signature and date after the declaration at the end of the TEAS response form, and print or type the name of the signatory immediately below or adjacent to his/her signature or identify it elsewhere in the filing.
