The referenced application has been reviewed by the assigned trademark examining attorney. Applicant must respond timely and completely to the issue(s) below. 15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.
The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d). TMEP §704.02; see 15 U.S.C. §1052(d).
Identification and Classification of Goods
The applicant identified its goods as “Starters, alternators and batteries for land vehicles,” Class 007.
Applicant has classified “batteries for land vehicles” in International Class 007; however, the proper classification is International Class 009. Therefore, applicant must either (1) add International Class 009 to the application and reclassify these goods in the proper international class, or (2) delete the wording “batteries for land vehicles” from the application. See 37 C.F.R. §§2.86, 6.1; TMEP §§1403 et seq. If applicant adds one or more international classes to the application, applicant must comply with the multiple-class requirements specified in this Office action.
The applicant may adopt the following if accurate:
Class 007: Starters and alternators for land vehicles
Class 009: BATTERIES FOR LAND VEHICLES
Identifications of goods can be amended only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted. 37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07. Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.
Proper classification of goods is a purely administrative matter within the sole discretion of the United States Patent and Trademark Office. In re Tee-Pak, Inc., 164 USPQ 88, 89 (TTAB 1969).

Requirements for Combined Applications
(1) Applicant must list the goods by international class; and
(2) Applicant must submit a filing fee for each international class of goods not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).

Fee for Adding Additional Classes
The filing fee for adding classes to an application is as follows:

(2) $375 per class, when the fees are submitted with a paper response.
