NO CONFLICTING MARKS:

 

The trademark examining attorney has searched the Office’s database of registered and pending marks and has found no conflicting marks that would bar registration under Trademark Act Section 2(d).  TMEP §704.02; see 15 U.S.C. §1052(d).

 

IDENTIFICATION OF GOODS:

 

Class 12 -

 

In Class 12, applicant’s identification is: “Land vehicle parts, namely, track assemblies and systems, and parts therefor, for use in converting standard wheel-based vehicles to vehicles with all-terrain track assembly systems.” 

 

The word “system” in the identification of goods is indefinite and must be amended to list the major parts or components of the system, as well as describe the nature, purpose and use of the system.  Applicant should use common generic terms when specifying the parts or components of the system.  See TMEP §§1401.02(a), 1402.01.

 

The examiner has visited applicant’s website.  See attachments at <http://www.americantracktruck.com/index.php?page=track-system-information>.  It appears that applicant’s track system primarily consists of a track and support frame.  See below for suggestions. 

 

Taking the above together, applicant may adopt the following:

 

Class 12: Land vehicle parts, namely, all-terrain endless track assembly systems and component parts thereof comprising of tracks and support frame for converting and modifying standard wheel-based vehicles to all-terrain vehicles featuring track assemblies
