This is in response to the Suspension Notice issued December 9, 2011.
BACKGROUND
The USPTO issued a Suspension Notice on December 9, 2011 suspending the instant application pending the disposition of the prior pending application for UFC ULTIMATE FITNESS CENTER THE GYM THAT FITS YOUR LIFE!, Serial No. 85126538, (“Prior Pending Application”) as being a potential bar to registration. In the Suspension Notice, the Examiner asserts that since the Applicant’s filing date is subsequent to the effective filing date of the foregoing application, if and when the application registers, it may be cited against the instant application in a refusal to register under Section 2(d).
PRIOR PENDING APPLICATION ABANDONED
The Applicant for the Prior Pending Application filed an Express Abandonment on July 27, 2015.
CONCLUSION Based on the foregoing, the Applicant requests that the application be removed from suspension and because Applicant believes that all outstanding issues have been resolved, respectfully requests that the instant application be approved for publication. |
