Remand Letter

The trademark examining attorney requests that the Trademark Trial and Appeal Board remand this case to the examining attorney under 37 C.F.R. §2.142(d) for the following reason(s):

The applicant’s attorney, after filing an appeal brief but without the benefit of submitting a REQUEST FOR RECONSIDERATION, has now contacted the examining attorney and proposed amending the recitations in Classes 41 and 45 in such a manner as to obviate the Section 2(d) refusal now pending.
