Search Results

The Office records have been searched and there are no similar registered or pending marks that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.

Identification of Goods

The word “system” in the identification of goods is indefinite and must be amended to list the major parts or components of the system, as well as describe the nature, purpose and use of the system.  Applicant should use common generic terms when specifying the parts or components of the system.  See TMEP §§1401.02(a), 1402.01.

Applicant must amend the wording to specify the common commercial or generic name for the goods.  If the goods have no common commercial or generic name, applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s).  TMEP §1402.01.

The examining attorney suggests, and applicant may adopt, any or all of the following identification of goods, if accurate:

“System for remotely operating medical devices primarily comprised of [specify main components of system by common commercial name, e.g., computer displays and monitors and controllers therefor used in direct association with medical diagnosis apparatus during the process of diagnosis of a condition in an individual; Displays, monitors and controllers for medical fluid injectors, namely, computer displays with computer monitors and controllers therefor used in direct association with medical fluid injectors, etc.],” in International Class 10.

TMEP §1402.01.

Identifications of goods can be amended only to clarify or limit the goods; adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification

For assistance with identifying and classifying goods or services in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tess2.gov.uspto.report/netahtml/tidm.html.  See TMEP §1402.04.
