Mr. Carter,
I tried to leave you a voice mail message a short time ago, but I don’t think I was able to finish the message. I apologize for any confusion. I received your response regarding the above mentioned application. The substitute specimen for Class 014, and the amendment for Class 025 are accepted. Further, the addition of Class 022 and the specimen for Class 022 are accepted.
The wording for the identification for Class 022, however, requires a bit more tweaking. Specifically, the use of the term “or” is unacceptable as indefinite. I propose that we change the term to “and” (i.e., lanyards for holding eyeglasses, badges, keys, retractable reels, identification badges, cards, whistles, cell phones, mp3 players, lip balm, and small tools.”)
I would be happy to make the change by Examiner’s Amendment rather than issuing a formal Final Office Action. Please let me know if this is acceptable. Feel free to email or phone at the number listed below. I appreciate in advance you prompt attention to this matter. Thank you.
