In a Trademark Act Section 66(a) application, classification of goods/services may not be changed from that assigned by the International Bureau of the World Intellectual Property Organization.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).  Additionally, classes may not be added or services transferred from one class to another in a multiple-class Section 66(a) application.  37 C.F.R. §2.85(d); TMEP §1401.03(d). 

 

The USPTO has the discretion to determine the degree of particularity needed to clearly identify services covered by a mark.  In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d 1593, 1597 (TTAB 2014) (citing In re Omega SA, 494 F.3d 1362, 1365, 83 USPQ2d 1541, 1543-44 (Fed. Cir. 2007)).  Accordingly, the USPTO requires the description of services in a U.S. application to be specific, definite, clear, accurate, and concise.  TMEP §1402.01; see In re Fiat Grp. Mktg. & Corp. Commc’ns S.p.A, 109 USPQ2d at 1597-98; Cal. Spray-Chem. Corp. v. Osmose Wood Pres. Co. of Am., 102 USPQ 321, 322 (Comm’r Pats. 1954). 

 

The identification of goods and/or services contains brackets and parentheses.  Generally, applicants should not use parentheses and brackets in identifications in their applications so as to avoid confusion with the USPTO’s practice of using parentheses and brackets in registrations to indicate goods and/or services that have been deleted from registrations or in an affidavit of incontestability to indicate goods and/or services not claimed.  See TMEP §1402.12.  The only exception is that parenthetical information is permitted in identifications in an application if it serves to explain or translate the matter immediately preceding the parenthetical phrase in such a way that it does not affect the clarity or scope of the identification, e.g., “fried tofu pieces (abura-age).”  Id.

 

Therefore, applicant must remove the brackets and parentheses from the identification and incorporate any parenthetical or bracketed information into the description of the goods and/or services.

However, while the word “parts” alone is generally unacceptable for the reasons identified above, the wording “replacement parts therefor” or “structural parts therefor” is acceptable when it follows a definite identification of goods.  See TMEP §1402.03(a).

The wording “magnetic data carriers”, “recording discs”, “compact discs, DVDs, and other digital recording media” in the identification of goods is indefinite and must be clarified because it does not make clear whether the goods are sold blank.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.

 

The identification for software in International Class 9 is indefinite and must be clarified by amending to specify the purpose or function of the software.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.03(d).  If the software is content- or field-specific, applicant must also specify its content or field of use.  See TMEP §1402.03(d).  The USPTO requires such specificity in identifying computer software in order for a trademark examining attorney to examine the application properly and make appropriate decisions concerning possible conflicts between the applicant’s mark and other marks.  See In re N.A.D. Inc., 57 USPQ2d 1872, 1874 (TTAB 2000); TMEP §1402.03(d).

 

The international classification of goods in applications filed under Trademark Act Section 66(a) cannot be changed from the classification the International Bureau of the World Intellectual Property Organization assigned to the goods in the corresponding international registration.  37 C.F.R. §2.85(d); TMEP §1401.03(d).  Therefore, although software may be classified in international classes other than International Class 9 (i.e., International Classes 41 and 42), any modification to the identification must identify goods in International Class 9 only, the class specified in the application for such goods.  See TMEP §1904.02(c)(ii).

 

The following are examples of acceptable identifications for software in International Class 9:  “downloadable mobile applications for managing bank accounts,” “desktop publishing software,” “tax preparation software.”

 

The wording “electric wiring devices and instruments” in the identification of goods is indefinite and must be clarified because it does not make clear the devices and instruments to be included.  See 37 C.F.R. §2.32(a)(6); TMEP §1402.01.

Applicant may amend the identification to clarify or limit the goods and services, but not to broaden or expand the goods and services beyond those in the original application or as acceptably amended.  See 37 C.F.R. §2.71(a); TMEP §1402.06.  Generally, any deleted goods and services may not later be reinserted.  See TMEP §1402.07(e). 

 

Additionally, for applications filed under Trademark Act Section 66(a), the scope of the identification for purposes of permissible amendments is limited by the international class assigned by the International Bureau of the World Intellectual Property Organization (International Bureau); and the classification of goods and services may not be changed from that assigned by the International Bureau.  37 C.F.R. §2.85(d); TMEP §§1401.03(d), 1904.02(b).  Further, in a multiple-class Section 66(a) application, classes may not be added or goods and services transferred from one existing class to another.  37 C.F.R. §2.85(d); TMEP §1401.03(d).

ENTITY & CITIZENSHIP CLARIFICATION REQUIRED

 

Applicant must specify its legal entity and national citizenship or foreign country of organization or incorporation, as this required information is not included in the application.  See 37 C.F.R. §§2.32(a)(3)(i)-(ii), 2.61(b); TMEP §§803.03, 803.04.  This information is required for all U.S. trademark applications, including those filed under Trademark Act Section 66(a).  See 37 C.F.R. §7.25(a)-(b); TMEP §1904.02(a). 

 

Acceptable legal entities include an individual, a partnership, a corporation, a joint venture, or the foreign equivalent.  See TMEP §§803.03 et seq.  If applicant’s legal entity is an individual, applicant must so specify and provide his or her national citizenship.  TMEP §803.03(a).  If applicant is a corporation, association, partnership, joint venture, or the foreign equivalent, applicant must so specify and provide the foreign country under whose laws applicant is organized or incorporated.  TMEP §803.03(b)-(c).  For an association, applicant must also specify whether the association is incorporated or unincorporated, unless the foreign country and the designation or description “association/associazione” appear in Appendix D of the Trademark Manual of Examining Procedure (TMEP).  TMEP §803.03(c).  If applicant is organized under the laws of a foreign province or geographical region, applicant should specify both the foreign province or geographical region and the foreign country in which the province or region is located.  See TMEP §803.04. 

 

To provide this entity information using the Trademark Electronic Application System (TEAS) Response to Office Action form, applicant must open the response form, answer “Yes” to wizard question number 5, find the “Owner Information” page, and do the following:  (1) locate the “Entity Type” heading on that page and select “Other;” (2) locate the “Specify Entity Type” heading and select “Other” under the Foreign Entity option, and enter in the free-text field below both applicant’s entity type and the foreign province or geographical region of its organization (e.g., partnership of Victoria); and (3) locate the “State or Country Where Legally Organized” heading and select the appropriate foreign country (e.g., Australia) under the Non-U.S. Entity option.

 

REQUEST FOR INFORMATION REGARDING GOODS IN CLASS 20

 

To permit proper examination of the application, applicant must submit additional information about the goods in Class 20.  See 37 C.F.R. §§2.61(b), 2.69; In re Stellar Int’l, Inc., 159 USPQ 48, 50-52 (TTAB 1968); TMEP §§814, 907.  The requested information should include fact sheets, brochures, advertisements, and/or similar materials relating to the goods.  If such materials are not available, applicant must provide a detailed factual description of the goods.  Any information submitted in response to this requirement must clearly and accurately indicate the nature of the goods identified in the application. 

 

In addition, applicant must submit a written statement indicating whether all the goods identified in the application comply with relevant federal law, including the Endangered Species Act (ESA), 16 U.S.C. §§1531-1544/Marine Mammal Protection Act (MMPA), 16 U.S.C. §§1361-1407/African Elephant Conservation Act, 16 U.S.C. §§4201-4246.  See TMEP §1401.14(f).  This law prohibits or restricts commerce related to goods comprised of or services related to bone/whalebone/horn.  That is, the ESA and associated regulations prohibit importing, exporting, selling, delivering, receiving, carrying, transporting, or shipping in interstate or foreign commerce African or Asian elephant ivory other than for excepted goods/MMPA and associated regulations prohibit the possession, transport, purchase, sale, import, or export of a marine mammal or marine mammal products taken in violation of the MMPA other than for excepted purposes/African Elephant Conservation Act prohibits importing and exporting African elephant ivory.

 

Finally, applicant must provide written responses to the following questions:

 

(1)        Does the bone/whalebone/horn fall under an exception in the ESA/MMPA/African Elephant Conservation Act?

 

(2)        If these goods and/or services fall under an exception in the ESA/MMPA/African Elephant Conservation Act, please explain how the goods and/or services constitute an exception.  For example, if the goods qualify as exempted antiques under the ESA, please provide such information.

 

Failure to comply with a request for information is grounds for refusing registration.  In re Harley, 119 USPQ2d 1755, 1757-58 (TTAB 2016); TMEP §814.  Merely stating that information about the goods and services is available on applicant’s website is an insufficient response and will not make the relevant information of record.  See In re Planalytics, Inc., 70 USPQ2d 1453, 1457-58 (TTAB 2004). 

 

Applicant is advised that, if applicant’s response to this request for information indicates that the goods identified in the application do not comply with the ESA/MMPA/African Elephant Conservation Act, registration may be refused on the ground that the applied-for mark is not in lawful use in commerce. In general, foreign attorneys are not permitted to represent applicants before the USPTO (e.g., file written communications, authorize an amendment to an application, or submit legal arguments in response to a requirement or refusal).  See 37 C.F.R. §11.14(c), (e); TMEP §§602.03-.03(b), 608.01.
