The Examining Attorney has rejected this application pursuant to 15 U.S.C. ? 1052(d) on the basis that the mark LENOVO is likely to be confused with the mark contained in Registration No. 4,763,338 for STONEWARE A LENOVO COMPANY, owned by Lenovo (Singapore) Pte. Ltd. ("Registrant"). Applicant respectfully submits, however, that no likelihood of confusion exists between Applicant's mark and Registrant's mark because Registrant has assigned all rights, title and interest in such mark and registration to Applicant, as evidenced by the attached Assignment and confirmation of submission for recordation with the USPTO. Accordingly, Applicant submits that its mark is entitled to registration, and respectfully requests such action.
