The assigned trademark examining attorney has reviewed the referenced application and has determined the following:
Search Results Under Trademark Act §2(d)
The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
However, the mark cannot proceed to publication until the following requirement has been satisfied.
The language “insurance claims administration services” in the recitation of services is acceptable. However, the current wording “insurance underwriting services” used to describe the services needs clarification because it is too broad. Applicant needs to specify the types of insurance it underwrites. Applicant may adopt the following recitation of services, if accurate:
Class 36: ______ {specify type of insurance, e.g., fire, life, marine} insurance underwriting; insurance claims administration services
TMEP §1402.01. For assistance with identifying and classifying goods and/or services in trademark applications, please see the online searchable Manual of Acceptable Identifications of Goods and Services at http://tess2.gov.uspto.report/netahtml/tidm.html.
Please note that, while the recitation of services may be amended to clarify or limit the services, adding to the services or broadening the scope of the services is not permitted. 37 C.F.R. §2.71(a); TMEP §1402.06. Therefore, applicant may not amend the identification to include goods and/or services that are not within the scope of the services set forth in the present identification.
If applicant should fail to respond to this Office action within the six month time limit, then the following services will be deleted from the application: “insurance underwriting.” The application will then proceed forward for the following services only: “insurance claims administration services.” 37 C.F.R. §2.65(a).
If applicant has questions about its application or needs assistance in responding to this Office action, please telephone the assigned trademark examining attorney directly at the number below.
