The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

However, the applicant must address the following informality.

 

Entity

 

Applicant’s entity type requires clarification.  In the “Applicant’s Entity Type” section of the application, applicant identifies itself as an LLC (or a limited liability company) and as a corporation.  As such, the applicant must specify the type of entity applying, i.e., a corporation, or a limited liability company.

 

If the applicant is a limited liability company, the applicant must change the “Applicant’s Name” and “Applicant’s Entity Type” sections of the application to the following, if accurate:  Ozark Land & Property, L.L.C., a limited liability company organized under the laws of Missouri.”  TMEP §803.03(h).
