NOTICE OF SUSPENSION

 

SUSPENSION PROCEDURE:  This suspension notice serves to suspend action on the application for the reason(s) specified below.  No response is needed.  37 C.F.R. §2.67.  However, the examining attorney will conduct periodic status checks and may issue inquiries at 6 month intervals from the mailing date of this notice.  TMEP §716.05.  If a status inquiry Office action issues, applicant will have 6 months from the mailing or e-mailing date of the status inquiry to respond.  15 U.S.C. §1062(b); 37 C.F.R. §2.62.

 

Mailing/E-Mailing Date Information:  If the mailing or e-mailing date of this Office action does not appear above, this information can be obtained by visiting the USPTO website at http://tarr.gov.uspto.report/, inserting the application serial number, and viewing the prosecution history for the mailing date of the most recently issued Office communication.

 

 

This letter responds to the applicant’s communication filed on August 31, 2006.

Action on this application is suspended pending receipt of a true copy, a photocopy, a certification, or a certified copy of a foreign registration from applicant's country of origin[1].  If the registration is in a foreign language, an English translation must also be submitted.  15 U.S.C. §1126(e); 37 C.F.R. §§2.34(a)(3)(ii); TMEP §§716.02(b), 1004 et seq.  Please note that applicant must notify the examining attorney if the foreign application abandons.

 

IDENTIFICATION & CLASSIFICATION OF GOODS  TMEP §1402.01.

 

Applicant has submitted the following amended identification of goods for International Class 009:

 

Computer database and computer software for inputting, storing, processing and retrieving information relating to the operation of a personnel staffing services business; software for evaluating and training employees and job candidates; Software in the field of human resource management; software in the field of employee procurement; Computer software for assessing job, business, contact center, customer service, clerical accounting, basic accounting, word processing, and office automation software skills; computer software for use in job, business, word processing, and office automation software training;

The duplicate wording “software in the field of human resource management  and software in the field of employee procurement” in the amended identification of goods remains unacceptable as indefinite. 

Applicant must specify the function of the software not merely the field of use.

This requirement is maintained.

 

 

The applicant may wish to consult the on-line identification manual on the PTO homepage for

acceptable common names of goods and services.

37 C.F.R. Section 2.71(a); TMEP §1402.06   While an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  Therefor, the applicant may not amend to include any goods/services that are not within the scope of the goods/services recited in the present identification.
