OFFICE RECORDS SEARCH:  The Office records have been searched and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

ADVISORY – AMENDMENTS TO GOODS/SERVICES:  If the identification of goods and/or services has been amended below, any future amendments must be in accordance with 37 C.F.R. §2.71(a) and TMEP §1402.07(e).

 

AMENDMENT(S) AUTHORIZED:  As authorized by Erik Pelton on October 3, 2006, the application is amended as noted below.  If applicant disagrees with or objects to any of the amendments below, please notify the undersigned trademark examining attorney immediately.  Otherwise, no response is necessary.  TMEP §707.  Please note that all issues not discussed in this office action have been resolved.

 

Identification and Classification

The identification of goods and/or services is amended to read as follows [changes in bold text]: 

 

Metal tent poles and stakes in International Class 6;

 

Eyewear, namely, sunglasses, sports glasses and protective eyewear, and replacement lenses for all of the foregoing; optical frames for men, women and children, and eyeglasses cases, goggles, eyeglass and sunglass chains and bands; bivouac sacks, namely, wind and water resistant bags into which a person can fit to protect themselves from exposure to the elements in International Class 9;

 

All purpose sporting bags, backpacks, day packs, internal and external frame packs, knapsacks, rucksacks, book bags, tote bags, handbags, duffel bags, messenger bags, hip and lumbar packs, hip belts, luggage in International Class 18;

 

Sleeping bags, sleeping bag pads, sleeping bag liners, non-metal tent stakes and poles in International Class 20;

 

Tents and tent accessories, namely, rain flies, vinyl ground cloths, tent storage bags, non-metal gear loft platforms used for storage, and tent pole storage sacks in International Class 22.

Lower Filing Fee
