Section 2(d) - Likelihood of Confusion Refusal

 

Registration was refused under Trademark Act Section 2(d), 15 U.S.C. §1052(d), because the mark for which registration is sought so resembles the mark shown in U.S. Registration No. 2623438 as to be likely, when used for the identified services, to cause confusion, or to cause mistake, or to deceive.  The refusal to register applicant’s mark on the Principal Register under Section 2(d) of the Trademark Act is maintained and continued.

Applicant’s mark is PEGASYS for “insurance claim auditing services” and “insurance claim processing, namely, administration, tracking and monitoring of health insurance claims.”  Registrant’s mark is PEGASUS ADVISORS (with the wording ADVISORS disclaimed) for “consulting and brokerage services in the field of reinsurance and risk management.”

 

Trademark Act Section 2(d) bars registration where an applied-for mark so resembles a registered mark that it is likely, when applied to the goods and/or services, to cause confusion, mistake or to deceive the potential consumer as to the source of the goods and/or services.  TMEP §1207.01.  The Court in In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973), listed the principal factors to consider in determining whether there is a likelihood of confusion.  Among these factors are the similarity of the marks as to appearance, sound, meaning and commercial impression, and the relatedness of the goods and/or services.  The overriding concern is to prevent buyer confusion as to the source of the goods and/or services.  In re Shell Oil Co., 992 F.2d 1204, 1208, 26 USPQ2d 1687, 1690 (Fed. Cir. 1993).  Therefore, any doubt as to the existence of a likelihood of confusion must be resolved in favor of the registrant.  In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); Lone Star Mfg. Co. v. Bill Beasley, Inc., 498 F.2d 906, 182 USPQ 368 (C.C.P.A. 1974).

 

Taking into account the relevant du Pont factors, a likelihood of confusion determination in this case involves a two-part analysis.  First, the marks are compared for similarities in appearance, sound, connotation and commercial impression.  In re E .I. du Pont de Nemours & Co., 476 F.2d 1357, 177 USPQ 563 (C.C.P.A. 1973).  Second, the goods or services are compared to determine whether they are similar or related or whether the activities surrounding their marketing are such that confusion as to origin is likely.  In re National Novice Hockey League, Inc., 222 USPQ 638 (TTAB 1984); In re August Storck KG, 218 USPQ 823 (TTAB 1983); In re Int’l Tel. and Tel. Corp., 197 USPQ 910 (TTAB 1978); Guardian Prods. Co., v. Scott Paper Co., 200 USPQ 738 (TTAB 1978); TMEP §§1207.01 et seq.

 

Similarity of the Marks

 

Again, applicant’s mark is PEGASYS while registrant’s mark is PEGASUS ADVISORS (with the wording ADVISORS disclaimed).  Disclaimed matter is typically less significant or less dominant when comparing marks.  Although a disclaimed portion of a mark certainly cannot be ignored, and the marks must be compared in their entireties, one feature of a mark may be more significant in creating a commercial impression.  In re Dixie Restaurants Inc., 105 F.3d 1405, 41 USPQ2d 1531 (Fed. Cir. 1997); In re National Data Corporation, 753 F.2d 1056, 224 USPQ 749 (Fed. Cir. 1985); and In re Appetito Provisions Co. Inc., 3 USPQ2d 1553 (TTAB 1987).  See also Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ 2d 1001 (Fed. Cir. 2002); Tektronix, Inc. v. Daktronics, Inc., 534 F.2d 915, 189 USPQ 693 (C.C.P.A. 1976); In re El Torito Rests. Inc., 9 USPQ2d 2002 (TTAB 1988); In re Equitable Bancorporation, 229 USPQ 709 (TTAB 1986).

 

Thus, the dominant portion of registrant’s mark is the wording PEGASUS.  This dominant portion of registrant’s mark and applicant’s mark are essentially phonetic equivalents and are thus similar sounding.  Similarity in sound alone may be sufficient to support a finding of likelihood of confusion.  RE/MAX of America, Inc. v. Realty Mart, Inc., 207 USPQ 960, 964 (TTAB 1980); Molenaar, Inc. v. Happy Toys Inc., 188 USPQ 469 (TTAB 1975); In re Cresco Mfg. Co., 138 USPQ 401 (TTAB 1963); TMEP §1207.01(b)(iv).  The only difference in the wording is applicant’s use of the letter “Y” in place of registrant’s use of the letter “U.”  This difference is not enough to obviate the similarities between the marks.

 

Relatedness of the Services

 

Again, applicant’s services are “insurance claim auditing services” and “insurance claim processing, namely, administration, tracking and monitoring of health insurance claims,” while registrant’s services are “consulting and brokerage services in the field of reinsurance and risk management.”

 

Applicant argues these services are not related.  However, as shown in the evidence of record provided by the previous examining attorneys, as well as the attached Internet, LexisNexis and third party registration evidence, these services are highly related in that they are often provided by the same entities under the same mark.

 

The attached Internet articles show entities providing both insurance claim processing services and risk management brokerage services under the same mark. The attached articles also show entities providing both reinsurance brokerage services and claims administration services.

 

In support of this position, the examining attorney attaches excerpts of four stories taken from the LEXIS/NEXIS computer database.  The examining attorney conducted a search of the phrase “insurance claim administration risk management brokerage” in the US file of the NEWS library.  The search resulted in 178 hits.  The attached excerpts represent a sampling of the results of that search.  The Trademark Trial and Appeal Board has held that materials obtained through computerized text searching are competent evidence to show the descriptive use of terms under Trademark Act Section 2(e)(1), 15 U.S.C. §1052(e)(1).  In re National Data Corp., 222 USPQ 515, 517 n.3 (TTAB 1984); TMEP §710.01(a).

 

Finally, attached are copies of printouts from the USPTO X-Search database, which show third-party registrations of marks used in connection with the same or similar services as those of applicant and registrant in this case.  These printouts have probative value to the extent that they serve to suggest that the services listed therein, namely insurance claim processing services and risk management services, are of a kind that may emanate from a single source.  See In re Infinity Broad. Corp., 60 USPQ2d 1214, 1217-1218 (TTAB 2001); In re Albert Trostel & Sons Co., 29 USPQ2d 1783, 1785-86 (TTAB 1993); In re Mucky Duck Mustard Co., Inc., 6 USPQ2d 1467, 1470 at n.6 (TTAB 1988).

 

Conclusion

 

Any doubt regarding a likelihood of confusion is resolved in favor of the prior registrant.  Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 62 USPQ2d 1001, 1004 (Fed. Cir. 2002); In re Hyper Shoppes (Ohio), Inc., 837 F.2d 463, 6 USPQ2d 1025 (Fed. Cir. 1988); TMEP §§1207.01(d)(i).  Therefore, because the marks are highly similar and the services are highly related, the refusal to register under Section 2(d) of the Trademark Act is maintained and continued.
