Description of Services

 

1. Applicant's prior response.

 

Applicant has revised the description of services complying with the suggestions made by the Examining Attorney in a response filed March 17, 2006 and labeled "Response to Office Action."  In that response, Applicant requested that:

 

1) This application, Ser. No. 78/589,650, be revised to contain only International Class 36 services:

 

Operating marketplaces for sellers of goods and services in the field of real estate; real estate agencies and brokerage; real estate consultancy, appraisal and valuation services, financial valuation of personal property and real estate; providing information in the field of real estate

 

2) All International Class 35 services be moved to Applicant's co-pending application for ZILLOW.COM in Class 35, Ser. No. 78/589,645, and that application be withdrawn from publication for the purpose of adding the transferred services.  Ser. No. 78/589,645 would then read:

 

Promoting the goods and services of others by means of linking the web site to other web sites featuring real estate, consumer goods and consumer services; advertising and marketing services in the fields of real estate, consumer goods and consumer services; on-line advertising and marketing services in the fields of real estate, consumer goods and consumer services; real estate sales management; real estate marketing services, namely, on-line services featuring tours of real estate; organization of internet auctions; organization of internet real estate auctions; providing an on-line showroom for the goods of others in the field of real estate, consumer goods and consumer services; providing information in the field of consumer goods for home maintenance, decoration and sales, and consumer services relating to real estate;

 

2. Error – creation of a new child application.

 

Rather than doing the above, there was an error in processing Applicant's Office Action Response of March 17, 2006.  The result was that a new application was created for the Class 36 services, Ser. No. 78/976,968, and two applications now exist for the Class 35 services, as follows:

 

Ser. No. 78/589,650 (Class 35): Promoting the goods and services of others by means of linking the web site to other web sites featuring real estate, consumer goods and consumer services

Ser. No. 78/589,645 (Class 35): Advertising and marketing services in the fields of real estate, consumer goods and consumer services; on-line advertising and marketing services in the fields of real estate, consumer goods and consumer services; real estate sales management; real estate marketing services, namely, on-line services featuring tours of real estate; organization of internet auctions; organization of internet real estate auctions; providing an on-line showroom for the goods of others in the field of real estate, consumer goods and consumer services; providing information in the field of consumer goods for home maintenance, decoration and sales, and consumer services relating to real estate

Ser. No. 78/976,968 (Class 36): Operating marketplaces for sellers of goods and services in the field of real estate; real estate agencies and brokerage; real estate consultancy, appraisal and valuation services, financial valuation of personal property and real estate; providing information in the field of real estate

 

3. Applicant's conversations with the Examining Attorney and future steps.

 

Applicant has conversed with the Examining Attorney several times.  The Examining Attorney is working to correct this error by deleting Ser. No. 78/976,968, and withdrawing from publication Ser. No. 78/589,645 and Ser. No. 78/589,650, revising the descriptions of services as follows:

 

Ser. No. 78/589,650 (Class 36): Operating marketplaces for sellers of goods and services in the field of real estate; real estate agencies and brokerage; real estate consultancy, appraisal and valuation services, financial valuation of personal property and real estate; providing information in the field of real estate

Ser.
