EXPLANATION OF FILING

n accordance with TMEP Sections 1201.02(c) and 1609.10(b), Registrant respectfully requests a correction of Registrant's entity on the Certificate of Registration for the mark shown in Reg. No. 3,276,336 and in the USPTO records. Registrant's correct entity is and has always been Roche Diagnostics Operations, Inc., a Delaware corporation.   The entity is not and has never been an Indiana corporation, as was set out in the original application.   This was an error in the representation of Registrant's domicile and entity status that occurred in good faith; however, it is a correctable error because the listed entity did not exist on the application filing date and this correction shows the correct and true entity that did exist and which submitted the application at that time.   The requested change does not require republication of the mark and it does not substitute another entity as the owner.  Accordingly, Registrant respectfully requests that the correction be made and the registration information be updated.
