This response is filed in answer to the Office Action of September 10, 2003.
In that action, the Examiner initially indicated that his search of the
Office records had disclosed no prior registration or pending application
which would bar registration of applicant's mark. The Examiner did find the
description of goods to be unacceptable; inquired as to whether applicant's
mark had any significance in the relevant trade, any geographical
significance or any meaning in a foreign language; and requested additional
information about applicant's general partner.
In response, applicant amends the description of goods in International
class 3 to read as follows:
"Lip and skin care products namely: lip balm; non-medicated lip
ointment for the prevention and treatment of blistered, chapped, sunburned
and irritated lips, cold sores, and fever blisters; and, sun screen."
No change is made to the description of goods in International class 5.
The mark Blistex has no significance in the relevant trade, nor any
geographical significance, nor any meaning in a foreign language.
Applicant's general partner is Sharon M. Bracken, a citizen of the United
States.
This response addresses every issue raised by the Office Action and no other
issues remain and thus this application is in condition for publication and
issuance.
