EXPLANATION OF FILING
Netflix, Inc., owner of U.S. Reg. No. 3,194,832, has changed its mark to the altered form shown in the accompanying drawing and requests that this registration be amended in accordance with Section 7(e) of the Act of July 5, 1946 (15 U.S.C. 1051 et seq., as amended). An updated Certificate of Registration is respectfully requested. The mark in its altered form is in use in interstate commerce by Registrant. Registrant submits that the changes to the logo maintain the essence of the original mark and do not materially alter the commercial impression created by the mark. The wording "NETFLIX" and the bending arc running along the bottom of the letters create the essence of the original mark. The revisions to this logo are limited to: 1) a slightly wider font; and 2) filling in the white space of the outlined letters. These changes do not materially alter the character of the mark, and Registrant submits that the altered mark creates the impression of being essentially the same mark as in the original registration. One specimen evidencing the use of the mark for the services recited in Class 41 is presented with this Section 7 Request in accordance with 37 C.F.R. Section 2.173, along with the fee of $100.00 pursuant to 37 C.F.R. Section 2.6(a)(11). This specimen was in use in commerce at least as early as the filing date of this Section 7 Amendment.
