Request to Divide Application

To the Commissioner for Trademarks:

The following is submitted for application serial number. 77651978 :

FORM INFORMATION

Applicant hereby requests that application Ser. No. 77/651,978 be divided.  Applicant requests that all of the Class 42 services from the "parent" application Ser. No. 77/651,978 be divided out into a new "child" application. Applicant intends that all of the Class 36 services remain in the "parent" application Ser. No. 77/651,978.

Therefore, after the division:

(1) the existing "parent" application Ser. No. 77/651,978 will only contain the Class 36 services, and

(2) the new "child" application will only contain the Class 42 services.

Applicant notes that there is a Response to Office Action due tomorrow, January 8, 2010.  Applicant will, of course, file the Response under the "parent" application Ser. No. 77/651,978.  As the Response also pertains to the new "child" application, Applicant has attached the Response here as a pdf.  Additionally, Applicant will attempt to file the response with the new "child" application (if the system allows) after this Request to Divide has been entered.

Therefore, to ensure that the Examining Attorney receives the Response in connection with both the "parent" and "child" applications, Applicant:

(1) has attached the Response in connection with this Request to Divide;

(2) will also attempt to file the response with the new "child" application after the Request to Divide has been entered; and

(3) will file the response with the exisiting "parent" application Ser. No. 77/651,978.
