To the Commissioner for Trademarks:

The following is submitted for application serial number. 77954148 :

            Applicant hereby Petitions the Director to Remand the instant application to the Examiner for consideration of the below Post-Publication Amendment to the Basis for registration.

 

AMENDMENT

 

            Applicant hereby amends its above application by inserting the following statement in the application:

---Applicant has a bona fide intention to use the mark in commerce on or in connection with the above-identified goods based on registration of the mark in CTM, namely, CTM Trade Mark Registration No. 008936544, dated August 24, 2010 and, Applicant submits a certification, certified copy or a true copy of said registration in accordance with 15 U.S.C. § 1126(e).---

 

--- Registration is valid for ten years to August 24, 2020. ---

 

            Applicant further amends the Application by deleting the Section 1(b) basis after the examination and acceptance of the CTM registration so that the application can proceed solely on the Section 44(e) basis.

 

REMARKS

            This amendment is requested after the issuance of a Notice of Allowance. 

            The application has been amended to include a claim of ownership of Applicant’s CTM certificate of registration.  The Applicant has a bona fide and effective commercial establishment in the CTM.

            Applicant requests that the instant the application be remanded to the Examiner for consideration of the instant amendment to change the basis to Section 44(e).
