This final Office action responds to the applicant’s communication of November 19, 2010.

PARTIAL REQUIREMENT: IDENTIFICATION OF SERVICES
In the first Office action, the examining attorney informed applicant that the identification of services was unacceptable as indefinite. In response, the applicant has submitted proposed amendments. The examining attorney has carefully reviewed these amendments and determined that they are acceptable with the exception of the following wording. As a result of this remaining unacceptable wording, the requirement for an acceptable identification of services is maintained and made FINAL.
Insurance claims auditing services, in Class 35;
Insurance underwriting in the fields of [specify fields of use, e.g., health, life, fire], insurance administration, insurance claims processing, and insurance brokerage services, in Class 36.

MULTI-CLASS APPLICATION
(1) LIST GOODS AND/OR SERVICES BY INTERNATIONAL CLASS: Applicant must list the goods and/or services by international class; and
(2) PROVIDE FEES FOR ALL INTERNATIONAL CLASSES: Applicant must submit an application filing fee for each international class of goods and/or services not covered by the fee(s) already paid (confirm current fee information at http://www.uspto.gov, click on “View Fee Schedule” under the column titled “Trademarks”).

RESPONDING TO THIS OFFICE ACTION
If applicant does not respond to this Office action within six months of the issue/mailing date, or responds by expressly abandoning the application, the application process will end, the trademark will fail to register, and the application fee will not be refunded. See 15 U.S.C. §1062(b); 37 C.F.R. §§2.65(a), 2.68(a), 2.209(a); TMEP §§405.04, 718.01, 718.02. Where the application has been abandoned for failure to respond to an Office action, applicant’s only option would be to file a timely petition to revive the application, which, if granted, would allow the application to return to live status. See 37 C.F.R. §2.66; TMEP §1714. There is a $100 fee for such petitions. See 37 C.F.R. §§2.6, 2.66(b)(1).
