Applicant requests an amendment of the filing basis for this application to Section 44(e).  Applicant submits a copy of United Kingdom Registration No. 2428953, for the mark CBEEBIES, which registered on February 9, 2007.  Please withdraw the Notice of Allowance and remand the application to the examining attorney for further reconsideration.  If the United Kingdom Registration is acceptable, please delete Section 1(b) as a filing basis and allow this registration to proceed solely on the basis of Section 44(e)
