Applicant is the owner of U.S. Registration No. 3633064.
Failure to comply with a disclaimer requirement can result in a refusal to register the entire mark. TMEP §1213.01(b).
In this case, the term “OUTDOOR” describes something “located in, done in, or suited to the open air” (see attached online dictionary excerpt). Applicant has identified goods encompassing those for use outdoors. As such, the referenced wording is merely descriptive because it states the nature or intended use of some or all of the applicant’s goods. See In re Omaha National Corp., 819 F.2d 1117, 2 USPQ2d 1859 (Fed. Cir. 1987); In re Newport Fastener Co. Inc., 5 USPQ2d 1064, 1067 n. 4 (TTAB 1987); TMEP §1213.08(c).
A properly worded disclaimer should read as follows:
“No claim is made to the exclusive right to use “OUTDOOR” apart from the mark as shown.”
