OFFICE SEARCH:  The examining attorney has searched the Office’s database of registered and pending marksand has found no conflicting marks thatwould bar registration under Trademark Act Section 2(d).  15 U.S.C. §1052(d); TMEP §704.02.   

 

AMENDMENT:  In accordance with the authorization granted by Ms. Mason on March 20^th, 2009, the application has been AMENDED as indicated below.  Please advise the undersigned examining attorney immediately if there is an objection to the amendment.  Otherwise, no response is necessary.  TMEP §707.

 

If the identification of goods and/or services has been amended, please note that any future amendments must be in accordance with 37 C.F.R. §2.71(a) and TMEP §1402.07(e).

 

Please delete the description of the mark as the drawing clearly shows of what the mark consists.

 

As to the identification of goods, please make the following changes:

 

INT CL 4:  delete “xylene used in the manufacture of dyes” as this is an INT CL 1 good.

 

INT CL 17:  have it now read as follows:  metalized plastic film for industrial use, plastic film for commercial and industrial use, plastic hoses, plastic laminates, plastic pipes, plastic plates for industrial use, plastic rods, plastic sheets for industrial use, synthetic resins in the form of blocks, bars, pellets, or powders for general industrial use, synthetic rubber
