The assigned examining attorney has reviewed the trademark application identified above. Applicant must respond to all of the issues discussed below, before the response deadline. 15 U.S.C. §1062(B); 37 C.F.R. §§2.62, 2.65(a); TMEP §§711, 718.03.

 

SECTION 2(d) REFUSAL – LIKELIHOOD OF CONFUSION

Registration of the applied-for mark is refused because of a likelihood of confusion with the mark in U.S. Registration No. 2814573.  Trademark Act Section 2(d), 15 U.S.C. §1052(d); see TMEP §§1207.01 et seq.  See the enclosed registration.

 

Taking into account the relevant du Pont factors, a likelihood of confusion determination in this case involves a two-part analysis.  The marks are compared for similarities in their appearance, sound, connotation and commercial impression.  TMEP §§1207.01, 1207.01(b).  The goods and/or services are compared to determine whether they are similar or commercially related or travel in the same trade channels.  See Herbko Int’l, Inc. v. Kappa Books, Inc., 308 F.3d 1156, 1164-65, 64 USPQ2d 1375, 1380 (Fed. Cir. 2002); Han Beauty, Inc. v. Alberto-Culver Co., 236 F.3d 1333, 1336, 57 USPQ2d 1557, 1559 (Fed. Cir. 2001); TMEP §§1207.01, 1207.01(a)(vi).

 

In this case, applicant’s mark is BARCLAYS, for use on

 

Financial services, namely, the provision of private equity services; venture capital services; fund management services; investment trust services; equity finance services; investment management services; investment advisory services; investment and equity asset management services; trust management services; unit trust services; equity and venture capital services; hedge fund services; hedge fund management services; financial investment in the field of hedge funds; investing the funds of others in private hedge funds; financial research in the field of hedge funds; brokerage of hedge funds; facilitating and processing investments in hedge funds; providing analysis of the performance of hedge funds; tracking order entries and position keeping, namely, keeping a record of positions held by hedge funds; pricing of securities held in the portfolios of hedge funds; transfer agency support for hedge funds, namely processing subscriptions, redemption and transfers of interests in hedge funds; corporate fund management services; consultancy, advisory and information services relating to the aforesaid services

 

The registered mark is PERFORMANCE THROUGH INNOVATION BARCLAYS GLOBAL INVESTORS, used on

 

bank services, mutual fund investment advisory services, investment management services, financial services in the nature of pooled investment funds

 

SIMILARITY OF THE MARKS

 

In a likelihood of confusion determination, the marks are compared for similarities in their appearance, sound, meaning or connotation and commercial impression.  In re E. I. du Pont de Nemours & Co., 476 F.2d 1357, 1361, 177 USPQ 563, 567 (C.C.P.A. 1973); TMEP §1207.01(b).  Similarity in any one of these elements may be sufficient to find a likelihood of confusion.  In re White Swan Ltd., 8 USPQ2d 1534, 1535 (TTAB 1988); In re Lamson Oil Co., 6 USPQ2d 1041, 1043 (TTAB 1987); see TMEP §1207.01(b).

 

In this case, applicant’s mark is similar to the registered mark in meaning, connotation and commercial impression. While the registered mark contains a number of elements in addition to the shared element BARCLAYS, the most distinct part of the registered mark is the word BARCLAYS. This also comprises all of applicant’s mark. The wording GLOBAL INVESTORS is disclaimed in the registered mark, and although a disclaimed portion of a mark certainly cannot be ignored, and the marks must be compared in their entireties, one feature of a mark may be more significant in creating a commercial impression.  Disclaimed matter is typically less significant or less dominant when comparing marks.  See In re Dixie Rests. Inc., 105 F.3d 1405, 1407, 41 USPQ2d 1531, 1533-34 (Fed. Cir. 1997); In re Nat’l Data Corp., 753 F.2d 1056, 1060, 224 USPQ 749, 752 (Fed. Cir. 1985); TMEP §1207.01(b)(viii), (c)(ii).

 

The wording PERFORMANCE THROUGH INNOVATION in the registered mark also cannot be ignored, but consumers are likely to consider this a marketing catchphrase used by BARCLAYS and not the primary trademark. In this way, the shared element BARCLAYS is the most significant part of the registered mark. This makes applicant’s mark similar to the registered mark.

 

When an applicant’s mark is similar to a registered mark, confusion is likely if applicant’s services are similar to the services on which the registered mark is used.

 

SIMILARITY OF THE SERVICES

 

The services of the parties need not be identical or directly competitive to find a likelihood of confusion.  See Safety-Kleen Corp. v. Dresser Indus., Inc., 518 F.2d 1399, 1404, 186 USPQ 476, 480 (C.C.P.A. 1975); TMEP §1207.01(a)(i).  Rather, they need only be related in some manner, or the conditions surrounding their marketing are such that they would be encountered by the same purchasers under circumstances that would give rise to the mistaken belief that the services come from a common source.  In re Total Quality Group, Inc., 51 USPQ2d 1474, 1476 (TTAB 1999); TMEP §1207.01(a)(i); see, e.g., On-line Careline Inc. v. Am. Online Inc., 229 F.3d 1080, 1086-87, 56 USPQ2d 1471, 1475-76 (Fed. Cir. 2000); In re Martin’s Famous Pastry Shoppe, Inc., 748 F.2d 1565, 1566-68, 223 USPQ 1289, 1290 (Fed. Cir. 1984).

 

In this case, both the registered mark and applicant’s mark are used on a wide range of financial investment services. Likelihood of confusion is determined on the basis of the services as they are identified in the application and registration.  Hewlett-Packard Co. v. Packard Press Inc., 281 F.3d 1261, 1267-68, 62 USPQ2d 1001, 1004-05 (Fed. Cir. 2002); In re Shell Oil Co., 992 F.2d 1204, 1207 n.4, 26 USPQ2d 1687, 1690 n.4 (Fed. Cir. 1993); TMEP §1207.01(a)(iii).

                                                           

When the application and the registration describe the services broadly and there are no limitations as to their nature, type, channels of trade or classes of purchasers, then it is presumed that the application encompasses all services of the type described, that they move in all normal channels of trade, and that they are available to all potential customers.  See In re Melville Corp., 18 USPQ2d 1386, 1388 (TTAB 1991) (“With reference to the channels of trade, applicant’s argument that its goods are sold only in its own retail stores is not persuasive . . . . There is no restriction [in its identification of goods] as to the channels of trade in which the goods are sold.”); TMEP §1207.01(a)(iii).

 

The examining attorney notes that both applicant’s mark and the registered mark are for use on “investment management services.” In this way, in particular, the services are identical. Additionally, applicant’s other services appear to focus largely on hedge funds, while the services provided under the registered mark include mutual fund services. The attached evidence shows:

 

(1)   U.S. Registration No. 3324531 for the mark BBU BANK EVERYONE COUNTS, used on services including hedge fund and mutual fund investment services,

(2)   U.S. Registration No. 3297960 for the mark  ALPHA ADVANTAGE (owned by applicant) used (by applicant) on services including mutual fund investment advisory services and hedge fund investment services,

(3)   U.S. Registration No. 3382698 for the mark WHEELHOUSE FUNDS used on services including mutual fund and hedge fund investments,

 

The attached evidence shows that consumers are accustomed to seeing both hedge funds and mutual funds offered under a single mark. In fact applicant’s customers can receive these services together under the mark ALPHA ADVANTAGE, from applicant. This makes applicant’s services similar to the services provided under the registered mark.

 

Based on the foregoing, applicant’s services are similar to the services on which the registered mark is used. Because applicant’s mark is similar to the registered mark and applicant’s services are also similar to the services on which the registered mark is used, applicant’s mark may not register.

 

If the mark in the cited registration has been assigned to applicant, applicant can provide evidence of ownership of the mark by satisfying one of the following:

 

(1)   Record the assignment with the Assignment Services Division of the Office and provide a written statement to the trademark examining attorney that the assignment has been duly recorded;

(2)   Submit copies of documents evidencing chain of title; or

(3)   Submit the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §2.20:  “Applicant is the owner of U.S. Registration No. 2814573.” 

 

TMEP §812.01; see 15 U.S.C. §1060; 37 C.F.R. §§3.25, 3.73; TMEP §502.02(a).

 

However, applicant must note the following additional refusal.

 

SECTION 2(e)(4) REFUSAL – PRIMARILY MERELY A SURNAME

 

Registration is refused because the applied-for mark is primarily merely a surname.  Trademark Act Section 2(e)(4), 15 U.S.C. §1052(e)(4); see TMEP §1211.  The primary significance of the mark to the purchasing public determines whether a term is primarily merely a surname.  In re Etablissements Darty et Fils, 759 F.2d 15, 17-18, 225 USPQ 652, 653 (Fed. Cir. 1985); In re Kahan & Weisz Jewelry Mfg. Corp., 508 F.2d 831, 832, 184 USPQ 421, 422 (C.C.P.A. 1975); see TMEP §§1211, 1211.01.

 

Please see the attached evidence (below) from LexisNexis, establishing the surname significance of the surname BARCLAY.  This evidence shows the applied-for mark appearing 5,446 times as a surname in a nationwide telephone directory of names.

 

Presentation of a surname in its plural or possessive form does not diminish its surname significance.  TMEP §1211.01(b)(v); see In re Woolley’s Petite Suites, 18 USPQ2d 1810 (TTAB 1991) (WOOLLEY’S); In re Luis Caballero, S.A., 223 USPQ 355 (TTAB 1984) (BURDONS).

 

A mark deemed primarily merely a surname may be registered on the Principal Register under Trademark Act Section 2(f) by satisfying one of the following:

 

(1)        Submitting a claim of ownership of one or more prior registrations on the Principal Register for a mark that is the same as the mark in the application and for the same or related goods and/or services.  37 C.F.R. §2.41(b); TMEP §1212.04.  The following wording is suggested:  “The mark has become distinctive under Section 2(f) of the goods or services as evidenced by ownership of U.S. Registration No(s). (provide registration numbers here) on the Principal Register for the same mark for related goods or services.” TMEP §1212.04(e).;

 

(2)        Submitting the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §§2.20, 2.33:  “The mark has become distinctive of the goods and/or services through applicant’s substantially exclusive and continuous use in commerce for at least the five years immediately before the date of this statement.”  37 C.F.R. §2.41(b); TMEP §1212.05(d).; or

 

(3)        Submitting actual evidence of acquired distinctiveness.  37 C.F.R. §2.41(a); TMEP §1212.06,  Such evidence may include the following:  examples of advertising and promotional materials that specifically promote the applied-for mark as a trademark or service mark in the United States; dollar figures for advertising devoted to such promotion; dealer and consumer statements of recognition of the applied-for mark as a trademark or service mark; and any other evidence that establishes recognition of the applied-for mark as a source-identifier for the goods and/or services.  See In re Ideal Indus., Inc., 508 F.2d 1336, 184 USPQ 487 (C.C.P.A. 1975); In re Instant Transactions Corp. of Am., 201 USPQ 957 (TTAB 1979); TMEP §§1212.06 et seq.

 

Trademark Act Section 2(f), 15 U.S.C. §1052(f); see 37 C.F.R. §2.41; TMEP §§1211, 1212.

 

If applicant cannot satisfy one of the above, applicant can amend the application to seek registration on the Supplemental Register.  Trademark Act Section 23, 15 U.S.C. §1091; see 37 C.F.R. §§2.47, 2.75(a).

 

Although the trademark examining attorney has refused registration, applicant may respond to the refusal to register by submitting evidence and arguments in support of registration. If applicant chooses to respond to the refusals to register, then applicant must also respond to the following.

 

PRIOR PENDING APPLICATION

 

Information regarding pending Application Serial No. 77347668 is enclosed.  The filing date of the referenced application precedes applicant’s filing date.  There may be a likelihood of confusion between the two marks under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  If the referenced application registers, registration may be refused in this case under Section 2(d).  37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, upon entry of a response to this Office action, action on this case may be suspended pending final disposition of the earlier-filed application.

 

The prior pending application is for the mark BARKLEY for use on

 

Banking

 

If applicant believes there is no potential conflict between this application and the earlier-filed application, then applicant may present arguments relevant to the issue in a response to this Office action.  The election not to submit arguments at this time in no way limits applicant’s right to address this issue at a later point.

 

However, applicant must respond to the following before the response deadline.

 

CLAIM OF OWNERSHIP OF REGISTRATIONS

 

If applicant is the owner of U.S. Registration Nos. 3195676, 2969746, 2305566 and others, then applicant must submit a claim of ownership.  37 C.F.R. §2.36; TMEP §812.  The following standard format is suggested:

IDENTIFICATION OF SERVICES

 

The identification of services is indefinite and must be clarified.  See TMEP §1402.01.  Applicant must specify the common commercial or generic name for the services.  If the services have no common commercial or generic name, applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s). 

 

Applicant may adopt the following identification (providing additional information where directed), if accurate:

Administrative processing of hedge fund investments orders for others

 

Class 36

The examining attorney was unable to provide alternative language for the services identified as:

 

tracking order entries and position keeping, namely, keeping a record of positions held by hedge funds

 

If these are in the nature of preparing financial reports, they would be classified in class 35. If it is a report on the ranking of hedge funds by their popularity among investors, it may be a news reporting service in class 41.

 

Also the nature of  “pricing of securities held in the portfolios of hedge funds” is unclear. Applicant must either provide an acceptable identification of these services, or provide information on the services to allow the examining attorney to properly identify and classify them.

Although identifications of services may be amended to clarify or limit the services, adding to or broadening the scope of the services is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include services that are not within the scope of the services set forth in the present identification.

 

ADDITIONAL CLASSES OF SERVICES

 

The application identifies services that are classified in at least 2 classes; however, the fees submitted are sufficient for only 1 class.  In a multiple-class application, a fee for each class is required.  37 C.F.R. §2.86(a)(2); TMEP §§810.01, 1403.01.

 

Therefore, applicant must either (1) restrict the application to the number of class(es) covered by the fee(s) already paid, or (2) submit the fees for the additional class(es). 

 

The filing fee for adding classes to an application is as follows:

 

         (1)     $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at

http://www.gov.uspto.report/teas/index.html; or

 

         (2)     $375 per class, when the fees are submitted with a paper response.

UNITED KINGDOM REGISTRATION CERTIFICATE REQUIRED

 

The application specifies a basis under Trademark Act Section 44(e); however, it does not include a copy of a foreign registration.  Applicant should note that a web-generated printout of information regarding a registration is not the same thing as a copy of the foreign registration certificate (or a copy thereof). An application filed under Section 44(e) must include a true copy, photocopy, certification or certified copy of a foreign registration from an applicant’s country of origin.  15 U.S.C. §1126(e); 37 C.F.R. §2.34(a)(3)(ii); TMEP §§1004, 1004.01, 1016.  In addition, the applicant’s country of origin must be a party to a convention or treaty relating to trademarks to which the United States is also a party, or must extend reciprocal registration rights to nationals of the United States by law.  15 U.S.C. §1126(b); TMEP §§1002.01, 1004.

 

Therefore, applicant must submit a copy of the foreign registration from applicant’s country of origin.  If the foreign certificate of registration is not written in English, applicant must also provide an English translation.  37 C.F.R. §2.34(a)(3)(ii).  The translation should be signed by the translator.  TMEP §1004.01(b).

 

A copy of a foreign registration must consist of a document issued to an applicant by or certified by the intellectual property office in the applicant’s country of origin.  TMEP §1004.01.  If an applicant’s country of origin does not issue registrations or certificates of extension of protection, the applicant may submit a copy of the international registration that shows that protection of the international registration has been extended to the applicant’s country of origin.  TMEP §1016.

 

DOMESTIC REPRESENTATIVE

 

Applicant may designate a domestic representative upon whom notices or process may be served.  If applicant does not designate a domestic representative, notices or process in proceedings affecting the mark may be served on the Director of the United States Patent and Trademark Office.  15 U.S.C. §§1051(e), 1141h(d); 37 C.F.R. §2.24; TMEP §604.
