OFFICE SEARCH:  The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d).  TMEP section 704.02. 

 

The following issues were discussed in communication with Max Moskowitz on February 20, 2008.

 

Identification of Goods

 

The identification of goods is unacceptable as indefinite.  The applicant must amend the identification to specify the common commercial name of the goods.  If there is no common commercial name, the applicant must describe the product and its intended uses.  TMEP section 1402.01. 

 

Specifically, the wording “sanitary cleansers” is unacceptable. Applicant should either indicate the common commercial name of the goods or describe their use. For example, applicant may amend this language to “sanitary preparations for medical use” or “disinfectants for sanitary purposes.”

 

 

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

 

The applicant may adopt the following identification of goods, if accurate: 

 

Germicides and disinfectants for sanitary purposes in International Class 5.
