This supplemental Office action is issued as the result of a directive from the Commissioner’s Office.

 

Identification of Goods

 

THIS REQUIREMENTAPPLIES ONLY TO THE GOODS SPECIFIED THEREIN:

 

Class 7: The wording “Sewing machines; embroidery machines; parts for sewing and embroidery machine parts, namely, machine controls, presser feet and peripheral units attachable to sewing machines” in the identification of goods is indefinite and must be clarified.  The wording "machine controls" is indefinite and could refer to electronic controls for machines in Class 9.  The wording "peripheral units" is indefinite.  The term "peripherals" has a definite meaning when used with computers, but not with sewing machines.  See TMEP §1402.01.  Applicant may substitute the following wording, if accurate:  “sewing machines, embroidery machines and parts and accessories therefore, namely machine controls, presser feet and peripheral units attachable to sewing machines sold as a unit” or “sewing machines; embroidery machines; parts for sewing and embroidery machines, namely electronic control systems for machines, presser feet and peripheral units, namely, _______ (list specific items).”

Although identifications of goods may be amended to clarify or limit the goods, adding to or broadening the scope of the goods is not permitted.  37 C.F.R. §2.71(a); see TMEP §§1402.06 et seq., 1402.07.  Therefore, applicant may not amend the identification to include goods that are not within the scope of the goods set forth in the present identification.

 

Failure to Respond – Abandonment of Specific Goods

 

If applicant does not respond to this Office action within the six-month period for response, then the following goods and/or services will be deleted from the application: parts for sewing and embroidery machine parts, namely, machine controls, presser feet and peripheral units attachable to sewing machines.  The application will then proceed with the following goods and/or services only:  all of the goods listed in Classes 9 and 16 and the “sewing machines; embroidery machines” listed in class 7.  37 C.F.R. §2.65(a).

 

Response Guidelines
