The applicant is requesting to divide the application and specifies the following:
The following good(s) or service(s) is/are now in use: Providing facilities for business meetings; arranging and conducting fairs and exhibitions for business and advertising purposes; retail museum stores (all in Class 035); Building management (Class 036); Providing facilities for recreational activities; providing facilities for movies, shows, plays, music or educational training; arranging of exhibitions, seminars and conferences; museums (all in Class 041); Providing facilities for exhibitions; provision of conference, exhibition and meeting facilities (all in Class 043)
The following good(s) or service(s) remain(s) under the Section 1(b), intent to use basis: Hotel management for others; operating of hotels for others (both in Class 035); rental of apartments; leasing of apartments; apartment housing management; condominium operation services, namely management services (all in Class 036); Class 037; Class 039; providing fitness and exercise facilities (Class 041); Hotel, bar and restaurant services; providing temporary lodging services (both in Class 043)
The applicant requests that the good(s)/service(s) based on use in commerce move to registration at this time.
Section 1(a) Good(s)/Service(s) Additional Information: The following services have been in use since the Applicant filed its Application for trademark on August 8, 2007: Providing facilities for business meetings; arranging and conducting fairs and exhibitions for business and advertising purposes; retail museum stores (all in Class 035); Providing facilities for recreational activities; providing facilities for movies, shows, plays, music or educational training; arranging of exhibitions, seminars and conferences; museums (all in Class 041); Providing facilities for exhibitions; provision of conference, exhibition and meeting facilities (all in Class 043). The Applicant is now filing a statement of use for building management in Class 036 with this filing. Applicant is also concurrently filing, via fax, a request to divide, requesting that all of these above-listed services be included in the child Application and proceed to registration. Applicant is also concurrently filing an SOU Extension Request via facsimile for all six International Classes in this Application. Applicant requests that "Real estate marketing services in the field of condominiums, apartments, luxury apartments and lofts" in Class 035 and "guided tours of an historical site" and "education research" both in Class 041 be deleted from the Application. Please note that the fees for the request to divide, along with four new applications fees (representing the four classes that have been internally divided) are being submitted via a credit card authorization form that has been sent by fax.






A fee payment in the amount of $100 will be submitted with the form, representing payment for the allegation of use for 1 class.

A fee payment in the amount of $100 will be submitted with the form, representing payment for the request to divide fee.

Applicant requests registration of the above-identified trademark/service mark in the United States Patent and Trademark Office on the Principal Register established by the Act of July 5, 1946 (15 U.S.C. Section 1051 et seq., as amended). Applicant is the owner of the mark sought to be registered, and is using the mark in commerce on or in connection with the goods/services identified above, as evidenced by the attached specimen(s) showing the mark as used in commerce.
