This responds to the Office Action sent on July 30, 2007 ("Office Action") regarding the application by Synchrony Health LLC ("Applicant") for
registration of the mark SYNCHRONY in Classes 5, 9, 16, 29, 41 and 44 (the "Mark"). ARGUMENT: U.S. Registration No. 1,507,528 (the "Registration") has been cited against the Application. Applicant
has deleted its Class 41 services. The citation should be removed from this Application as the services listed in the Registration do not overlap with the classes remaining in the Application. Per
the telephone conversation with the Examiner, the deletion of Class 41 is sufficient to remove the citation and move the Application on to publication. CONCLUSION: Applicant believes that it has
responded to the issues raised in the Office Action, and respectfully requests that the Mark proceed to publication. Please contact the undersigned with any questions. |
