Under 37 CFR §2.175, the Director may correct an error in a registration, upon written request and the payment of a required fee, provided the correction does not result in a change that would require republication of the mark. Pursuant to § 7 of the Trademark Act, Registrant herein petitions to correct an error in the registration. More particularly, the captioned registration was issued listing the state of incorporation of Registrant as Ohio. However, on review of this matter, it turns out that Registrant is actually a Delaware corporation. The error of listing Registrant as an Ohio corporation instead of a Delaware corporation occurred in good faith, as a result of the attorney’s lack of information concerning the proper state of incorporation of Registrant. In view of the foregoing, Registrant respectfully requests that the state of incorporation of Registrant be revised from Ohio to Delaware. The $100 fee for this communication is being submitted contemporaneaously with the submission of this request. However, if there are any further fees or any overpayment, please charge same to Deposit Account No. 06-0308.
