The statement of use has been reviewed by the assigned trademark examining attorney.  Applicant must respond timely and completely to the issue(s) below.  15 U.S.C. §1062(b); 37 C.F.R. §§2.62(a), 2.65(a); TMEP §§711, 718.03.

 

MODEL NUMBER

 

The notation “20,” which appears in the mark on the specimen, is not shown in the mark on the drawing, and clarification is needed.  If applicant believes this notation is not part of the mark and is merely a grade designation or model number, then applicant must submit a statement to that effect along with actual evidence showing use of the mark with other similar notations.  See TMEP §§807.12, 807.12(d).  In the alternative, applicant must provide evidence or a substitute specimen showing that the proposed mark displayed on the drawing creates a separate commercial impression.  See 37 C.F.R. §2.61(b); TMEP §807.12(d).

 

If applicant submits a substitute specimen, applicant should also include the following statement, verified with an affidavit or signed declaration under 37 C.F.R. §§2.20, 2.33:  “The substitute specimen was in use in commerce prior to the expiration of the time allowed applicant for filing a statement of use.”  37 C.F.R. §2.59(b)(2).
