Response to Office Action

To the Commissioner for Trademarks:

Application serial no. 77112967 has been amended as follows:

ARGUMENT(S)
In response to the substantive refusal(s), please note the following:

 

In a June 11, 2007 Office Action, the Examining Attorney refused registration under Trademark Act Section 2(d), 15 U.S.C. § 1052(d), on the grounds that Applicant's mark, when used on or in connection with the identified services in class 38, is likely to be confused with the marks in U.S. Registration Nos. 2584492 and 2897229.  The Examining Attorney also requested clarification of Applicant’s services. 

Applicant has petitioned to cancel Registration Nos. 2584492 and 2897229, and therefore asks that the present application be suspended pending disposition of those proceedings.  See ESTTA Tracking Nos. ESTTA180101 and ESTTA180099.  Applicant will respond to other informalities at a future date after its application is removed from suspension.
