Upon further review of the application, the following has been determined.

 

IDENTIFICATION OF GOODS AND/OR SERVICES

 

International Class 9

 

The wording “practical information on a wide variety of subject matters” in the identification of goods is indefinite and must be clarified because it does not indicate the specific subject matter by the common commercial name, for example, music.  See TMEP §1402.01.

 

International Class 41

 

The wording “instructional services featuring practical information on a wide variety of subjects provided in non-downloadable printed form on web pages” in the identification of services is indefinite and must be clarified because it is not clear whether the applicant is providing information on different topics or providing on-line publications.  Furthermore, the subject matter of the services must be clearly specified.  See TMEP §1402.01.  Applicant must amend this wording to specify the common commercial or generic name for the services.  If there is no common commercial or generic name for the services, then applicant must describe the nature of the services as well as their main purpose, channels of trade, and the intended consumer(s). 

 

Applicant may amend the identification to the following, if accurate:  providing on-line publications in the nature of indicate specific nature of the publications, e.g. e-zines featuring instruction on indicate subject matter of the publications

 

As identified above, the services are properly classified in International Class 41.

 

If the applicant is providing information services, the classification is dependent upon the subject matter of the information.

 

International Class 42

 

The wording “providing an on-line database containing information relating to practical information on a wide variety of subjects” in the identification of services is indefinite and must be clarified because it does not clearly identify the subject matter of the information.  See TMEP §1402.01.  Applicant must amend this wording to specify the subject matter of the information.

 

The classification of the services is dependent upon the subject matter of the information.

If applicant prosecutes this application as a combined, or multiple-class application, then applicant must comply with each of the following for those goods and/or services based on an intent to use the mark in commerce under Trademark Act Section 1(b);  a foreign registration under Trademark Act Section 44(e); an intent to use the mark under Trademark Act Section 1(b) and/or a foreign registration under Section 44(e):

 

(1)     Applicant must list the goods and/or services by international class; and

 

(2)     Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov).
