In response to this Office action, applicant may present arguments in support of registration by addressing the issue of the potential conflict between applicant’s mark and the mark in the referenced application. Applicant’s election not to submit arguments at this time in no way limits applicant’s right to address this issue later if a refusal under Section 2(d) issues.
If accurate, the following identification may be adopted: Computer database management software for importation of e-mail lists from Tessitera CRM System software for use in mass e-mailing and e-mail marketing campaigns.
DESCRIPTION OF THE MARK
Therefore, applicant must provide a more accurate description of the applied-for mark. The following is suggested:
The mark consists of the word and number “MAIL2” combined with all the letters in the mark in lower case to the left of which is a design of an envelope.
