Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 3376848 :

FORM INFORMATION

These comments are in response to the Examining Attorney’s post registration office action, issued on August 20, 2014, and in response to the telephone conversation that Stephen Garcia, counsel of record for Registrant, had with the Examining Attorney on January 26, 2015.  In the office action, the Examining Attorney alleged that:

“Office records show clear chain of title to the registration in INSOLVENCY SERVICES GROUP, INC. (CALIFORNIA CORPORATION). However, the party who filed the Combined Affidavit is identified as SPINMEDIA GROUP, INC. (CALIFORNIA CORPORATION).”

The Examining Attorney required that the party who filed the Combined Affidavit, i.e., SpinMedia Group, Inc. (“SMG”),  must establish its ownership of the registration.

To this end, Registrant respectfully submits the attached screenshots from the Trademark Office’s Assignments on the Web database, as well as a PDF copy of the related  assignment document, showing that, as of the date the Examining Attorney issued the office action, there was clear chain of title to the registration in SMG.  As the screenshots and assignment document show, Insolvency Services Group, Inc. assigned the registration to SMG on January 31, 2014, and recorded the assignment on February 5, 2014.

In light of these facts, Registrant respectfully requests that the Examining Attorney accept Registrant’s Combined Affidavit as submitted on August 4, 2014.
