The assigned trademark examining attorney has reviewed the referenced application and has determined the following:

 

Prior Pending Application

Information regarding pending Application Serial No. 78/545,714 is enclosed.  The filing date of the referenced application precedes applicant’s filing date.  There may be a likelihood of confusion between the two marks under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  If the referenced application registers, registration may be refused in this case under Section 2(d).  37 C.F.R. §2.83; TMEP §§1208 et seq.  Therefore, upon entry of a response to this Office action, action on this case may be suspended pending final disposition of the earlier-filed application.

 

If applicant believes there is no potential conflict between this application and the earlier-filed application, then applicant may present arguments relevant to the issue in a response to this Office action.  The election not to submit arguments at this time in no way limits applicant’s right to address this issue at a later point.

If applicant chooses to respond to the refusal(s) to register, then applicant must also respond to the following requirements.

Identification of Goods

 

The words “electronic water treatment system” in the identification of goods are unacceptable as indefinite.  In particular, the term “system” in the identification of goods is unclear and requires clarification.  Applicant must rewrite the goods by listing the major parts or components of the system and describing the nature, purpose and use of the system.  Applicant should use common generic terms when specifying the parts and/or components of the system.  TMEP §1402.03.

 

The applicant may adopt any or all of the following descriptions, if accurate: 

 

“Electronic water treatment system comprised of [indicate major parts or components of system, e.g., water level sensors, magnets, timing sensors, electronic speed controllers and electronic valves for controlling fluids]”, in International Class 9; and/or

 

“Electronic water treatment system comprised of [indicate major parts or components of system, e.g., bioreactors, cartridge filtration units, chemical sterilization units, reverse osmosis filtration units and ultraviolet sterilization units]”, in International Class 11

Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted.  37 C.F.R. §2.71(a); TMEP §1402.06.  Therefore, the applicant may not amend to include any goods that are not within the scope of goods set forth in the present identification.

 

Applicant must clarify the number of classes for which registration is sought.  The submitted filing fees are insufficient to cover all the classes in the application.  Specifically, the application identifies goods that are classified in at least two international classes, however applicant paid the fee for only one class.

 

Applicant must either: (1) restrict the application to the number of class(es) covered by the fee already paid, or (2) pay the required fee for each additional class(es).  37 C.F.R. §2.86(a)(2); TMEP §§810.0l, 1401.04, 1401.04(b) and 1403.01.

 

The filing fee for adding classes to an application is as follows:

 

(1)     $325 per class, when the fees are submitted with a response filed online via the Trademark Electronic Application System (TEAS) at http://www.gov.uspto.report/teas/index.html; and

 

(2)     $375 per class, when the fees are submitted with a paper response.

If applicant prosecutes this application as a combined, or multiple‑class application, then applicant must comply with each of the requirements below for those goods and/or services based on actual use in commerce under Trademark Act Section 1(a):

 

(1)   Applicant must list the goods/services by international class with the classes listed in ascending numerical order;

 

(2)   Applicant must submit a filing fee for each international class of goods and/or services not covered by the fee already paid (current fee information should be confirmed at http://www.uspto.gov); and

 

(3)   For each additional class of goods and/or services, applicant must submit:

 

(a)    dates of first use of the mark anywhere and dates of first use of the mark in commerce, or a statement that the dates of use in the initial application apply to that class; the dates of use, both anywhere and in commerce, must be at least as early as the filing date of the application;

 

(b)   one specimen showing use of the mark for each class of goods and/or services; the specimen must have been in use in commerce at least as early as the filing date of the application;

 

(c)    a statement that “the specimen was in use in commerce on or in connection with the goods and/or services listed in the application at least as early as the filing date of the application;” and

 

(d)   verification of the statements in 3(a) and 3(c) in an affidavit or a signed declaration under 37 C.F.R. §2.20.  (NOTE:  Verification is not required where (1) the dates of use for the added class are stated to be the same as the dates of use specified in the initial application, or (2) the original specimens are acceptable for the added class.)

Mark Differs on Drawing and Specimen

 

The mark as depicted on the drawing does not agree with the mark as it appears on the specimen, and clarification is required.  37 C.F.R. §2.51; TMEP §§807.12 and 807.12(a).  In the present case, the drawing displays the mark as  Z-GUARD, and the specimen shows the mark as GUARD in front of the letter “Z”.  Applicant may not submit an amended drawing to conform to the display on the specimen because the character of the mark would be materially altered, i.e., the mark on the specimens creates a different commercial impression from the mark on the drawing.  37 C.F.R. §2.72(a); TMEP §§807.12, 807.12(a), 807.14 et seq and 904.09. 

 

Therefore, applicant must do one of the following:

 

(1)   submit a substitute specimen showing use of the mark as it appears on the drawing, with a statement that “the substitute specimen was in use in commerce at least as early as the filing date of the application,” verified with an affidavit or a signed declaration under 37 C.F.R. §2.20; 37 C.F.R. §§2.59(a) and 2.72(a); TMEP §904.09 (A sample declaration is below for the applicant’s use); or

 

(2)   amend the basis to Section 1(b) and satisfy all the requirements for this new basis.  TMEP §806.03(c).

 

Declaration to Submit With Specimens

 

The substitute specimen was in use in commerce at least as early as the filing date of the application.

Substituting a Basis

 

If the applicant cannot comply with the requirement to produce specimens for the Section 1(a) basis asserted, the applicant may substitute a different basis for filing if the applicant can meet the requirements for the new basis.  See TMEP §§806.03 et seq.

 

In this case, applicant may wish to amend the filing basis associated with the goods listed in the application to Section 1(b) based on its bona fide intention to use the mark in commerce.  In this regard, applicant would have to submit the following statement for the record:

 

Applicant has had a bona fide intention to use the mark in commerce on or in connection with the goods listed in the application as of the filing date of the application.

 

This statement must be verified with a notarized affidavit or a signed declaration under 37 C.F.R. §§2.20 and 2.33.  Trademark Act Section 1(b), 15 U.S.C. §1051(b); 37 C.F.R. §2.34(a)(2); TMEP §806.01(b).  (A sample Declaration is attached below for the applicant’s use).
