The APPLICATION IS ABANDONED because the statement of use and the request for extension of time to file a statement of use were filed after the expiration of the current extension period.  The statement of use and extension request are untimely and will not be reviewed.  All fees will be refunded in due course. 

 

A statement of use or extension request is required to be filed within six months following the issuance of the notice of allowance or during an existing extension period.  15 U.S.C. §1051(d); 37 C.F.R. §§2.88(a) and 2.89; TMEP §§1108.01 and 1109.04.  In this case, a statement of use or extension request was due on or before January 10, 2007.  However, the statement of use and extension request were filed on January 25, 2007.
