ADVISORY – AMENDMENTS TO GOODS/SERVICES: If the identification of goods and/or services has been amended below, any future amendments must be in accordance with 37 C.F.R. §2.71(a) and TMEP §1402.07(e).
AMENDMENT(S) AUTHORIZED: As authorized by Deborah L. Benson, Atty. on October 20, 2005, the application is amended as noted below. If applicant disagrees with or objects to any of the amendments below, please notify the undersigned trademark examining attorney immediately. Otherwise, no response is necessary. TMEP §707.
Based on the following amendment to the identification of goods, the refusal based on Trademark Act §2(d) is withdrawn. It has been determined upon further inspection that the original specimen is acceptable as submitted, therefore the requirement for a new specimen is withdrawn.
The identification of goods is amended to read as follows:
Laboratory equipment, namely digital imaging systems comprising a digital camera and a tunable filter, used with microscopes or lenses to obtain images of samples or of natural scenes, and computer software for use in operating the digital imaging system, controlling the microscopes or lenses, or interpreting the images obtained thereby, and adaptors for microscopes and lenses, all of the foregoing sold separately or as a unit for optical imaging in International Class 9.
