In accordance with the authorization granted by Cheryl Friedman on October 18, 2004, the application has been AMENDED as indicated below. Please note that if the identification of goods or services has been amended below, any future amendments must be in accordance with 37 C.F.R. 2.71(a); TMEP section 1402.07(e). No response is necessary unless there is an objection to the amendment. If there is an objection to the amendment, the applicant should notify the examining attorney immediately.
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d). TMEP §704.02.
The class 9 goods are amended to delete the “s” from “games” and insert “programs” after “games” as underlined below:
“PRERECORDED VIDEO TAPES AND DVD'S CONTAINING ANIMATED MOTION PICTURES, PRERECORDED COMPACT DISCS AND AUDIO TAPES CONTAINING SOUND TRACKS FROM ANIMATED MOTION PICTURES, PRERECORDED AUDIO TAPES CONTAINING MUSIC FROM ANIMATED MOTION PICTURES, AND INTERACTIVE VIDEO GAME PROGRAMS CONTAINING CHARACTERS AND SCENES FROM ANIMATED MOTION PICTURES,” in class 9.
No claim is made to the exclusive right to use “ANIMATION” apart from the mark as shown.
The color description is amended as follows:
The mark consists of a boy in the moon and the following colors: red on the letters "D" and "W"; blue on the letters "R" and "O"; orange on the letters "E" and "R"; pink on the letters "A" and "K"; and green on the letters "M" and "S". Blue appears in the sky portion of the mark. The word ANIMATION appears in blue.
