| MISCELLANEOUS STATEMENT | In the Office Action dated August 17, 2004, the Examining Attorney determined that the specimen provided by Applicant is unacceptable as evidence of actual service mark use. Applicant hereby requests that the application be amended such that the basis for seeking registration of the mark is 15 U.S.C. § 1051(b), i.e. intent to use, rather than 15 U.S.C. § 1051(a), i.e. use in commerce. In addition, in the Office Action dated August 17, 2004, the Examining Attorney required Applicant to specify the significance of OC16. Applicant responds that OC is an acronym for Oceanic Cable, a name under which Applicant does business. 16 refers to the channel number assigned to Applicants cable station. Applicant is unaware of any other significance of OC16. |
