The assigned examining attorney has reviewed the referenced application and determined the following.
A. Search Results
The examining attorney has searched the Office records and has found no similar registered or pending mark which would bar registration under Trademark Act Section 2(d), 15 U.S.C. Section 1052(d). TMEP section 1105.01.
B. Identification of Goods
As a general rule, parentheses and brackets may not be used in the actual identification of goods or the recitation of services in trademark applications because the Office uses them to indicate that certain goods and services in registered marks are no longer in use. The applicant should bear in mind that brackets and parentheses shown in the identification manual are in the nature of directional signals, the significance of which is explained in the introduction to the Trademark Office Manual of Acceptable Identifications of Goods and Services. Thus, applicant must remove the parentheses from its identification of goods.
The applicant must rewrite the identification in its entirety, listing each good or service according to its appropriate international classification, with the international classes listed in ascending order. 37 C.F.R. Section 2.74(b). Please note that, while an application may be amended to clarify or limit the identification, additions to the identification are not permitted. 37 C.F.R. Section 2.71(a); TMEP section 804.09. Therefore, the applicant may not amend to include any goods or services that are not within the scope of the goods or services listed in the present identification.
C. Ownership of Prior Registration
If the applicant is the owner of Registration No. 2,864,719, the applicant must submit a claim of ownership. 37 C.F.R. Section 2.36; TMEP section 812.
