This application has been reinstated by the Commissioner for Trademarks for the second time.    The Office records have been searched again and no similar registered or pending mark has been found that would bar registration under Trademark Act Section 2(d), 15 U.S.C. §1052(d).  TMEP §704.02.

 

Applicant has stated that it did not receive the previous Office actions, although it has been sent to the applicant three times in the past two years via facsimile and email to the addresses and telephone numbers the applicant specified.  The trademark examining attorney has determined that all the issues raised in the Office action are still valid.  The applicant continues to claim it has not receive the Office actions, however it clearly has access to the Internet since it filed its reinstatement
