RESPONSE TO OFFICE ACTION FOR POST-REGISTRATION MATTER

 

Registrant hereby responds to the Office Action dated June 1, 2011

 

OWNER’S NAME

 

In the Post Registration Office Action, the Sections 8 & 15 Combined Affidavit submitted on May 4, 2011, was not accepted or acknowledged because the office records do not show clear chain of title in the party who filed the Combined Affidavit.  The owner’s name on the registration is identified as a Limited Partnership, but the Combined Affidavit is identified as a Partnership.  This mistake was merely a clerical error.  The owner’s actual name is the one state on the Registration; C.P. Pharmaceuticals International C.V., a Limited Partnership.  A typographical or clerical error in the owner’s name may be corrected.  See In re Atlanta Blue Print Co., 19 USPQ2d 1078 (Comm’r Pats. 1990); TMEP §1604.07(f).

 

As the outstanding issue has been addressed, Registrant requests that the Sections 8 & 15 Combined Affidavit be accepted.
