Response to Office Action for Post-Registration Matters

To the Commissioner for Trademarks:

The following is submitted for registration number. 2754123 MOVE BEYOND :

In the Office Action having an effective mailing date of September 24, 2013, it states that the Section 8 Affidavit was not accepted because the Office records show chain of title to the registration in Amer Sports International Oy (Finland Limited Liability Company), and the party who filed the Section 8 Affidavit is identified as Amer Sports International Oy (Finland Corporation).

In conjunction with this response, the Owner submits another Section 8 Affidavit in the name of Amer Sports International Oy, a limited liability company of Finland.  The previously submitted Section 8 Affidavit incorrectly listed Amer Sports International Oy as a corporation.  The specimen of the previously submitted affidavit remains valid and the Owner chooses to rely on the previously submitted specimen.

The present Section 8 Affidavit is being filed within the statutory filing period including the grace period.  The Owner believes the present Section 8 Affidavit satisfies the statutory requirements of Section 8 and overcomes the present Office Action non-acceptance of the Section 8 Affidavit.
